Parking in front of a garage without a ford

Parking in front of a garage without a ford

A permanent ford plate indicates that parking in front is prohibited in that place, so as not to impede the passage of vehicles to a garage.

There is a popular belief that only a ford or a yellow line makes it impossible to find a place to park the vehicle. The truth is that even in front of a garage that apparently does not have a municipal permit that prevents parking, parking is prohibited. In this case there is the option that the announcing plate of the ford may have been stolen or stolen, so the sanction continues its course. The owner of the ford You must have warned of the lack of signal and requested a new one, in addition to the fact that the ford has a duration determined by the authorities, so it remains valid as long as it has not expired.

But parking in front of a ford is obviously prohibited, but can you park in front of a garage that does not have such a municipal permit? When looking for a place to leave the vehicle, a parking exit is observed but next to it there is no ford sign, nor is there a yellow line painted on the curb, which would imply the same prohibition. The answer to this question is reflected in the Article 91.2c of the General Traffic Regulations.

One of the biggest problems we have in cities, in addition to having to deal with a large number of traffic, pedestrians and signs, is finding a place to park the car.

Precisely, one of the most common fines that we can find when we get to our car is to park our vehicle in a place that does not correspond to it. And it is that sometimes the rush prevents us from seeing a ford sign at the exit of a garage, a yellow line or a sign that prohibits parking. But… did you know that even if you park in a garage without a ford you can be fined?

And it is that according to Article 91 of the General Traffic Regulations, in its first section, “The stop and parking must be carried out in such a way that the vehicle does not hinder circulation or constitute a risk for the rest of the road users, paying special attention to the positioning of the vehicle and preventing it from moving in the absence of the driver”.

For this reason, even if we park in a garage exit without a ford, we can be fined up to 200 euros. Remember that if you appeal the fine you will not be able to exercise your right to pay only 50% of it.

The permanent ford plate placed in the access to garages or garages prohibits parking in front and thus prevents the exit or entrance to the property from being blocked. However, not everything goes to limit parking, but it must be indicated with correct signage to have the following privileges: the right of entry and exit 24 hours a day and the modification of the curb to facilitate the access of vehicles. Therefore, not any ‘no parking’ notification is valid to obey it.

In order to know that parking is effectively prohibited at the door of a garage, the ford must have the R-308 sign placed and with this, parking or stopping in front is prohibited. In the event of ignoring this indication, article 91.2 c) of the Traffic Regulations is violated, which establishes a fine of 200 euros “when the normal use of the exit passage or access to a property for people or animals, or vehicles in transit is hindered.” a properly signposted ford.”
Check that it is an authorized ford

The regulation specifies the term “correctly signposted ford” because the picaresque resorts to graffiti and ‘fords’ of doubtful reliability which, of course, are not authorized or binding. To make sure that it is indeed a reliable sign, the plate usually bears a municipal registration number, the coat of arms of the corresponding town hall, clarifying whether it is permanent or limited, and even a dry or embossed stamp from the Local Police.

The installation of the ford also prohibits the owner’s parking, since it would be reserved on the public highway for that citizen. In addition, the user must bear in mind that pedestrians always have priority because they circulate on the part of the road reserved for pedestrians, and it is the vehicle that must give way if, when entering or leaving the garage, it comes across a person.
How to request a ford

The licenses for the fords are temporary and renewable, and are granted by the City Council of the corresponding municipality to whoever requests it and proves that they are the owner of the property in question and pays the corresponding costs.

The price of a permanent ford depends on factors such as: the municipality in which it is requested, the category of street where the passage of vehicles is located, the space on the sidewalk that is going to be reserved and the surface of the garage to which it is going. to give access, since it is not the same that said ford implies providing a service to park a vehicle than as a garage for several spaces.

All about the false permanent ford – Reasons and fines

Taking advantage of the utility of the ford, many people buy fake R-308 signs and place them, without paying a license, so that no one parks at the door of their house.

To begin with, it should be clarified that a ford is not the right to have the entrance to the garage free, in fact, it has nothing to do with parking, rather it is a license that grants the right to use the sidewalk to put a vehicle into a property, garage, plot or premises.

Now that you know what a ford is, we’ll tell you all about the false permanent ford.

What is a false permanent ford?

Finding parking in many cities or certain neighborhoods is an arduous task, and sometimes impossible. What some drivers don’t realize is that many of the permanent ford signs they see on doors or gates are not real. They are just signs that have been hung by certain individuals so that they respect their space. This usually happens in hidden, small streets with little traffic.

It is estimated that in some Spanish municipalities 25% of the fords are placed without a license from the municipal council and without paying the fee.

Given this, it should be clarified that the permanent ford is issued by the municipalities, and placing the sign without having obtained the license entails a sanction (although it can be purchased in many places).

Normally the legal ford signs are printed on a 2 mm thick plate, and must have the name of the municipality, the seal or shield, the license number embossed in relief, the Police seal and are usually accompanied by the message “permanent ford” and/or “vehicle exit”. Of course, many times, the differences between a false R-308 signal and a true ford are very difficult to detect.

Along with false permanent ford plates, there are also individuals who paint a continuous yellow line on the immediate exit from their plot or premises, which, if true, would mean that stopping or parking is prohibited. Read about the meaning of the yellow lines here.

Reasons for not having the true permanent ford

There are 3 main reasons for not having a council permit to put a permanent ford on your property:

That person does not want to pay the ford in the town hall.
That the ford be denied for not having at least 2.5 meters wide at the door of the plot or garage.
Being denied the ford for not having a large enough garage.

On the part of the driver, it should be clarified that there will never be fines for parking in front of a false ford. Of course, you have to make sure that there is not a false plate on the door and a real one, because many times the neighbors who have been granted the authentic ford buy another plate without homologating in a hardware store or in a bazaar to emphasize the ford. Similarly, parking on yellow lines painted by a neighbor, or in front of doors with unofficial signs will not be punished either.

However, hanging a ford without having the license can cost the offender a fine that fluctuates between 501 euros and 901 euros. As the issue of fords is managed by the municipality, many municipalities also charge small amounts of 200 euros for putting up an unapproved sign, even with a license, as this can mislead drivers.

There are legal issues that, due to their importance for the citizen, are always controversial and confusing. Today we are going to try to treat one of them. It is about the prohibition (or not) of parking in front of a garage that does not have the Vado Permanente plate, that is, the municipal license.

Firstly, if there is a yellow line in that area. If it is continuous, you cannot park or stop. Here it would not be necessary to examine the existence or not of Vado, and there would be no doubt. Although be very careful with the picaresque: false Vado license plates or yellow lines painted by the neighbors themselves are situations that have occurred on numerous occasions.

Problems arise when, there being no Vado license plate, there is a broken yellow line (which allows parking and stopping at certain times of the day, depending on what the nearby signs indicate) or if there is no line at all. The question is, can I park in that place?

The General Traffic Regulations, in its article 91.2.c, establishes that “When the normal use of the exit passage or access to a property is hindered by people or animals, or vehicles in a properly marked ford”. If a car is obstructing the entrance or exit to a garage without a ford, there would be no legal obligation to remove it. And it is precisely that the payment of the Vado empowers its users to demand from the police authorities the removal of vehicles that obstruct the normal entry and exit of vehicles in that garage. But if a garage does not have a Vado, it does not have the right to have the municipal towing service agree to that request. With the payment of the Vado, what is being done is to compensate the City Council for the use that the vehicles make of the garage of the municipal sidewalks when entering and leaving, constituting an easement.

Therefore, in general terms, if a garage does not have a Ford, for municipal purposes it is not a garage. Of course, in practice it will depend on the interpretation given by the agent of the authority in question, who can, for example, process the complaint for blocking the garage but not proceed with the removal of the vehicle.

Our advice is that, faced with the possibility of parking in front of a garage without a ford, it is best not to do so, especially due to the tensions that may arise at the time. And it is that a recent Judgment of the Provincial Court of Valladolid, specifically, of September 27, 2013, condemns a woman to pay a fine of 120 euros for the crime of coercion: in this case, the woman parked for 2 hours in front of of a garage without the corresponding Vado plate, ignoring the complaints of the owners of said garage as well as the Civil Guard who later appeared at the place. As the Judgment says, the Vado grants the right to seek help from the authorities to remove the vehicles that obstruct the normal operation of the garage, but it does not mean that its normal use is authorized, affecting the domain faculties of its owners.
As for the opposite case, if you are the owner/user of a garage without a municipal license, it is best to apply for it to avoid all this type of situation.

Yes, but it is recommended that you be very sure that you can ‘get rid’ of it because If you appeal it, you will lose the right to pay only 50% in the voluntary period.

That the signal which indicates that you have committed the offense can’t look good (for a tree, for example) or that there is some erroneous information in the fine (address, vehicle registration, name and surname of the offender) can render the sanction null and void.
