A recent sentence of the Contentious-Administrative Court number 2 of Burgos upholds the appeal promoted by Associated European Motorists (AEA) and obliges Traffic to reimburse the points deducted when the tax system invalidates a fine.
A court in Burgos has just agreed with the organization AEA (Associated European Motorists) in relation to an appeal that requested refund deducted card points to drivers whose fines had been annulled by the Treasury. Specifically, the judicial resolution in February condemned the Directorate General of Traffic to return the points withdrawn from a truck driver who had previously had an economic fine annulled by an economic court in Castilla y León dependent on the Treasury for not having been correctly notified. From now on, many more could be added to this case, because AEA assures that since the introduction of the point-based card in 2006, the DGT has refused time after time to return the points improperly removed for badly processed and canceled fines.
These DGT fines are not entitled to a discount (not even with “prompt payment”)
It is convenient to make sure if the fine is well or badly notified
«It cannot be that the Treasury annuls the economic part of a fine and, nevertheless, the DGT maintains the deduction of the points. This judgment is a very important legal precedent. Based on this success achieved by our association, if a fine is not properly notified, not only must the economic part of the sanction be annulled, but also the “little bag of points” that accompanies it, using the words of Mr. Pere Navarro, that it was the general director of Traffic who launched the permit for points, “says Mario Arnaldo, president of Associated European Motorists.
DGT fines exceed a new collection record
A piece of information that is particularly important now is that, according to AEA, last December Traffic annulled around 1.5 million disciplinary proceedings in our country for a value of 106 million euros. Many of these files could be affected by the recent judicial resolution, “they say from the association.
